1. Titolare del Trattamento
TDS AI Systems di Paolo Consorti (libero professionista)
P.IVA: IT11524180962
Email: info@tds-automation.com
Sito web: tds-automation.com
Foro competente: Santa Maria Capua Vetere (CE), Italia
2. Dati Raccolti
Raccogliamo i seguenti dati personali esclusivamente quando forniti volontariamente dall'utente:
- Modulo di contatto: nome, email, azienda, tipo di attività, messaggio
- Newsletter: indirizzo email
6.1.a GDPR)
Base legale trasferimento extra-UE: Standard Contractual Clauses ex Art. 46(2)(c) GDPR e consenso esplicito dell'interessato Art. 6(1)(a). Server US. Privacy policy: tally.so/privacy.
Server US con SCCs.
Fornitori dell'assistente vocale ARIA.
text-embedding-3-small. Server US, SCC.
- Ogni contenuto generato dall'AI è chiaramente identificato come tale
Base giuridica
Consenso esplicito dell'interessato ai sensi dell'art. 6.1.a GDPR e art.
Brevo raccoglie metriche aggregate di consegna e apertura email a fini esclusivamente tecnici e statistici, senza profilazione individuale a fini pubblicitari.
Ultimo aggiornamento: 13 ottobre 2026 — sezioni 5, 6, 7, 7.1 e 9.
Privacy Policy
In accordance with EU Regulation 2016/679 (GDPR), TDS AI Systems provides the following information on the processing of personal data.
1. Data Controller

VAT: IT11524180962
Email: info@tds-automation.com
Website: tds-automation.com
Jurisdiction: Santa Maria Capua Vetere Court (CE), Italy
2. Data Collected
We collect the following personal data only when voluntarily provided by the user:
- Contact form: name, email, company, business type, message
- Newsletter: email address
- Browsing data: technical data collected automatically (IP address, browser, pages visited) through Cloudflare for site security
3. Purpose of Processing
- Responding to enquiries submitted through the contact form
- Sending communications about our services (only with consent)
- Managing newsletter subscriptions
- Ensuring site security and proper functioning
4. Legal Basis
- Consent: for marketing communications and newsletter (Art. 6.1.a GDPR)
- Contractual performance: for responding to service requests (Art. 6.1.b GDPR)
- Legitimate interest: for site security and aggregate analytics (Art. 6.1.f GDPR)
5. Data Retention
Personal data is retained only as long as necessary for the purposes for which it was collected:
- Contact data: maximum 24 months from the last interaction
- Newsletter: until unsubscription
- Browsing data: maximum 90 days
- Conversations with the ARIA voice assistant: neither the audio nor the transcript is retained by us. Google, which generates the replies, keeps the text of the conversation for up to 55 days, only to check for abuse (section 6). We keep the technical data of the session and the IP address: for this data we have not yet set a maximum retention period, and this is a gap (section 7.1); meanwhile we delete it when you ask us to. If you ask for a quote, for prices or for the links by email, what you leave us (the request and, if you give them, your name and email address) and the emails we send you are treated as contact data: maximum 24 months from the last interaction, unless a contract follows. Full detail in section 7.1.
6. Data Sharing and Sub-processors
Personal data is never sold to third parties. It may be shared with the following sub-processors:
- Google Workspace: for email, spreadsheet management, and storage of form responses (Google Sheets). Contract with Google Ireland Limited; Google servers in the EU or in other countries, with Standard Contractual Clauses (SCC).
- Tally Forms LLC: for collecting public form responses (waitlist, surveys, qualification questionnaires). Legal basis for extra-EU transfer: Standard Contractual Clauses under Art. 46(2)(c) GDPR and explicit consent of the data subject Art. 6(1)(a). US servers. Privacy policy: tally.so/privacy.
- OpenAI: for AI processing of documents and invoices on the platform. Data is anonymised before sending (PII removed); this does not apply to the ARIA voice assistant (see below). OpenAI does not use the data to train its models. Zero data retention is not enabled on our account — we have requested it from the vendor — so the default retention of up to 30 days for abuse monitoring applies. US servers with SCCs.
- Stripe: for payment processing. Payment data is handled directly by Stripe in compliance with PCI DSS. Stripe acts as an independent controller for payment data.
- Brevo (Sendinblue): for newsletter management (EU servers)
- Cloudflare: for site security and performance (global servers with adequate safeguards)
Providers of the ARIA voice assistant. If you talk to ARIA (the agent.html page), your data goes to the providers below; your voice goes only to the first two, in real time. A voice cannot be pseudonymised before transmission: the audio is itself personal data, and may contain whatever you choose to say.
- LiveKit Inc.: real-time transport (WebRTC) of the audio and of the written messages between your browser and the agent. It also receives your IP address, which the connection needs. Session recording is switched off; LiveKit does keep technical analytics data about the session, in the United States or in Europe depending on the region of our project. The connection goes through the LiveKit server closest to you, with no guarantee that the data stays in the European Union. US company: for transfers outside the EU its data processing agreement (DPA) provides for the EU-US Data Privacy Framework, which LiveKit states it has joined, and otherwise the Standard Contractual Clauses (Art. 46(2)(c) GDPR).
- Deepgram Inc.: speech-to-text transcription, and backup voice (text-to-speech) only for the sentences the main voice fails to speak, because of an error or a delay (also when its daily quota runs out). Receives your raw audio and, in that case, the text of the sentence. Processing on servers in the European Union, excluded from the provider’s model improvement programme: audio and text not kept after the response. US company. The data processing agreement (DPA, with the Standard Contractual Clauses): we have requested it from Deepgram, awaiting reply.
- Google (Gemini): the language model generating the replies and the synthetic voice speaking them. Receives the text of the conversation, never your audio. Paid service, under Google’s data processing terms. Google keeps prompts and replies for up to 55 days, only to detect and prevent abuse; during that time authorised Google staff may read them. It does not use them to train models, except those used for abuse monitoring. The data may be stored, even only briefly, in any country where Google has facilities, so also outside the EU; transfers are covered by the safeguards of Google’s terms (Standard Contractual Clauses and, for the Google companies that have joined it, the EU-US Data Privacy Framework).
- OpenAI: receives the technical record of every session — identifier, duration, message count, cost — and, only if you ask for a quote or for prices, the text we save about it (the request and, if you gave them, your name and email address: section 7.1); never the audio nor the rest of the conversation. For ARIA these texts are not anonymised. They are archived and turned into a numerical vector for internal search, via the
text-embedding-3-small model. US servers, SCC. Data sent via the API is not used to train models; zero data retention is not enabled on our account — we have requested it from the vendor — so the default retention of up to 30 days for abuse monitoring applies.
- Google Workspace (Gmail): when you give ARIA your email address, or ask for prices or a proposal. From our mailbox we send you the code to verify your address, the links to book a call, the quote confirmation and, for special requests, a summary of the request; our mail also keeps the draft quote, which Paolo Consorti reviews and sends, the alerts to Paolo Consorti with name, email address and request and, for requests for prices, an email with the summary of the request, which the system sends to our mailbox even if you leave no contact details. It therefore receives your email address, your name if you give it and, for quotes and requests for prices, your request. These emails stay in our mail for at most 24 months, like contact data. It is the same Google Workspace listed above: contract with Google Ireland Limited, Google servers in the EU or in other countries, SCC.
The technical library the ARIA page needs (LiveKit’s) is served from our own website, like the rest of the page: no additional service. If you book a call with ARIA’s links, you do so on the Calendly or Google Calendar website (section 7.1).
Since 12 October 2026 ARIA is only a voice: the video avatar is no longer active and Beyond Presence, which generated it, no longer receives any data.
7. Use of Artificial Intelligence
The TDS platform uses artificial intelligence (AI) technologies for document and invoice analysis. In compliance with Art. 50 of the EU AI Act:
- All AI-generated content is clearly identified as such
- For document and invoice analysis, personal data is pseudonymised before being sent to the AI provider. This does not apply to the ARIA voice assistant: a voice cannot be pseudonymised before transmission — see 7.1 below.
- No data is used to train third-party AI models; for the ARIA voice assistant, see the exceptions in section 7.1
- Users may request that their documents are not processed by AI
7.1 ARIA — voice assistant
ARIA is an artificial intelligence system, not a person. You are interacting with a machine: we state it here, it is written in the interface of the agent.html page, and it is repeated next to every reply. This fulfils Art. 50(1) of Regulation (EU) 2024/1689 (EU AI Act), applicable from 2 August 2026. ARIA is a limited-risk system: it makes no decisions about you, does not profile you, and produces no legal effects. ARIA is not aimed at minors and does not verify the age of whoever uses it.
What happens when you press “I agree”. On your first visit, a box first explains what happens to your voice. When you press “I agree” (or, later, “Start conversation”) the conversation starts and your browser requests access to your microphone. From that moment your voice is transmitted in real time to two of the providers listed in section 6: LiveKit, which carries it through its server closest to you, and Deepgram, which transcribes it on servers in the European Union. Both are US companies: for LiveKit the safeguards of its data processing agreement apply; for Deepgram we have requested the agreement, awaiting reply (section 6). A voice is personal data and cannot be anonymised before transmission: it can identify the speaker, and it may contain whatever you choose to say.
If you already consented on an earlier visit, your browser keeps that consent and the conversation may start by itself when the page opens, without you pressing anything; if your browser also remembers the microphone permission, the microphone opens without further questions. To go back to being asked explicitly, use “Withdraw consent” in the footer of the ARIA page, or clear this site's data in your browser; in any case you can end the session at any time.
How to protect yourself, concretely: do not tell ARIA anything you do not want leaving Europe — tax codes, bank details, health data, confidential information about clients or third parties. ARIA does not need any of it in order to answer.
- Legal basis for the conversation: consent (Art. 6(1)(a) GDPR), which you give by pressing “I agree” in the box shown before the conversation. The consent stays stored in your browser and also applies to later visits, until you withdraw it. Ending the session stops the processing under way, but does not withdraw the consent: to withdraw it use the “Withdraw consent” control in the footer of the ARIA page, or clear this site's data in your browser. Withdrawal does not affect the lawfulness of the processing carried out before it.
- Audio is not retained: it passes in real time and is not recorded on any system of ours.
- We do not keep the transcript either. The text of what you say is used only during the conversation: when the session closes we do not save it (only what concerns a request for a quote or for prices remains, as explained below). This has been the case since 31 July 2026, and it is a permanent choice for the public assistant. ARIA does not search previous conversations: every session starts from scratch. Google, which generates the replies, keeps the text for up to 55 days to check for abuse (section 6).
- Technical data and IP address: the session identifier, timestamps, duration, message count and cost are kept. The service also records your IP address in its technical logs each time a session starts, for diagnostics and security. If you ask for a code, the links or a quote, the logs also keep the initial and the domain of your email address (for example m***@example.com) and, for special requests, the names of the services requested. Legal basis: our legitimate interest in the security and proper functioning of the service (Art. 6(1)(f) GDPR); you may object by writing to privacy@tds-automation.com. Retention: the law sets no number of days, but it requires that data is not kept longer than necessary and that we say for how long we keep it. We must set this period ourselves and have not done so yet: until we do, this is a gap. Meanwhile you may ask us to delete this data at any time at the same address, without giving a reason: we do it without undue delay, and at the latest within one month. To find the data of a session we need the day, the time and, if you know it, your IP address.
- Quotes and links by email. If you ask ARIA for a quote, or to receive by email the links to book a call, ARIA asks for your email address and, for a quote, a name or company. Before sending you anything by email, ARIA normally verifies the address with a 6-digit code that we email to you and that is valid for 10 minutes. The system prepares the quote; Paolo Consorti receives an alert by email, reviews the quote and sends it to you: you receive it only after his review, and meanwhile you get a confirmation email. The quote request — name, email address, services and what you asked for — is saved in our internal archive, on one of our servers in Italy; its text goes through OpenAI for the search vector (section 6).
- Requests for prices. If you ask for prices or a proposal, ARIA may save in our archive a summary of the request (at most 500 characters), written by ARIA from your words, even if you leave no contact details; if you said them, the summary may also contain your name and email address. Its text goes through OpenAI for the search vector. The same summary also reaches us by email, in our mailbox (Google Workspace).
- Special requests. If the quote includes services that are not in our catalogue, the system automatically estimates how complex the request is (low, medium, high), only to help Paolo Consorti, who decides; it sends you an email with a summary of the request; and it saves in our archive a note with your name, your masked email address, the services and the estimate, also with the OpenAI vector.
- Bookings. If you use the links to book a call, the booking takes place on the Calendly website (Calendly LLC, a US company) or on the Google Calendar booking page (Google Workspace): the details you enter (name, email address, any notes, time) are received by that service and by us, to organise the call. We have not yet verified Calendly’s safeguards for transferring the data to the United States.
- Legal basis and retention of this data. Quotes, requests for prices, links by email and address verification: pre-contractual measures taken at your request (Art. 6(1)(b) GDPR). The request and, if you gave them, your name and email address, together with the emails we send you (code, links, confirmations, summaries) and the one with the summary of the request for prices, which stay in our mailbox, are treated as contact data: maximum 24 months from the last interaction. If a contract follows, the data is kept for as long as the law requires for the contract and for accounting. Your name and email address are needed only to send you the quote or the links: if you do not give them, ARIA can still answer you and give you the links in the chat. ARIA does not subscribe you to the newsletter.
- Model training: conversations are not used to train models, ours or the providers', with these exceptions. Google may use the text it keeps for abuse monitoring only for its own abuse-prevention systems. For Deepgram this holds from 8 October 2026: before then the exclusion from its model improvement programme was not active. For ElevenLabs, which until 8 October 2026 spoke ARIA’s replies and received their text, we are checking whether the training opt-out was active.
- No automated decision-making within the meaning of Art. 22 GDPR.
- Always verify what ARIA states before acting on it: like any generative system, it can be wrong.
8. Cookies
This site uses only strictly necessary technical cookies (Cloudflare). We do not use profiling cookies or third-party cookies for advertising purposes. For details, see the Cookie Policy.
9. User Rights
Under Articles 15-22 of the GDPR, you have the right to:
- Access your personal data
- Request rectification or deletion of your data
- Restrict or object to processing
- Request data portability
- Withdraw consent at any time, without affecting processing carried out before the withdrawal
- Lodge a complaint with the Italian Data Protection Authority (garanteprivacy.it)
To exercise your rights, write to: privacy@tds-automation.com
10. Security
We adopt appropriate technical and organisational measures to protect personal data, including SSL/TLS encryption, restricted data access, and regular backups.
11. Data Processing Agreement (DPA)
For business customers, a Data Processing Agreement (DPA) compliant with Art. 28 GDPR is available. Contact privacy@tds-automation.com to request a copy.
12. Newsletter and marketing communications
Subscription to the TDS AI Systems newsletter ("TDS Weekly") is voluntary and governed by explicit consent pursuant to Articles 6.1.a and 7 of the GDPR, as well as Article 130 of the Italian Personal Data Protection Code (Legislative Decree 196/2003 as amended), which requires specific prior consent for the sending of promotional communications by electronic mail.
Confirmation mechanism (Double Opt-In)
We adopt a double confirmation mechanism:
- The user submits their email address through the signup forms on the site (footer, Insights page, Founder page).
- A confirmation email is sent to the provided address, containing a unique activation link.
- Only after the confirmation link is clicked does the subscription become active and the address is added to the contact list.
This procedure ensures consent traceability pursuant to Art. 7.1 GDPR and protects the user from unwanted subscriptions submitted by third parties.
Purpose and content
The newsletter contains updates on TDS AI Systems services, anonymised case studies relating to Italian SMEs and professional firms, technical and regulatory news on artificial intelligence and data protection. No third-party promotional communications are sent. The expected frequency is one issue every two weeks, with occasional additional issues for material regulatory updates.
Legal basis
Explicit consent of the data subject pursuant to Art. 6.1.a GDPR and Art. 130 c. 1 of the Italian Privacy Code. Consent may be withdrawn at any time, without prejudice to the lawfulness of processing based on consent before its withdrawal (Art. 7.3 GDPR).
Data processor: Brevo
The technical management of the newsletter (email delivery, subscription and unsubscribe handling, aggregated open and click statistics) is entrusted to Sendinblue SAS (operating under the Brevo brand), with registered office at 106 Boulevard Haussmann, 75008 Paris, France. The servers used for processing are located within the European Union (France, Germany, Belgium). Brevo acts as Data Processor pursuant to Art. 28 GDPR, on the basis of the Data Processing Agreement available at help.brevo.com. Brevo collects aggregated delivery and open metrics for technical and statistical purposes only, without individual profiling for advertising.
Data retention
The subscribed email address is retained until consent is withdrawn. The consent log (subscription date, DOI confirmation, possible withdrawal) is retained for 24 months after withdrawal, pursuant to the burden of proof under Art. 7.1 GDPR.
Withdrawal mechanism
Every email sent contains an "Unsubscribe" link allowing immediate and free withdrawal of consent. Alternatively, requests can be sent to privacy@tds-automation.com. For further details on data subject rights, see section 9 of this policy.
Transfers and tracking
No newsletter data is transferred outside the EU. Outgoing emails may contain open and click tracking pixels; these are active solely for aggregate statistical purposes. For details on site cookies, see the Cookie Policy.
13. Lead-magnet and free resource downloads
Downloading free resources (PDF guides and documents, such as "Il Registro del Builder" and "Il Registro dell'Art.4") happens through subscription to the TDS Weekly newsletter: the user provides their email address, confirms the subscription, and receives both the requested document and the subsequent newsletter issues. Processing is governed by explicit consent pursuant to Articles 6.1.a and 7 GDPR and Article 130 of the Italian Privacy Code.
Consent and confirmation mechanism (Double Opt-In)
On the download page there is an explicit, non pre-selected consent checkbox stating both purposes: receiving the document and subscribing to TDS Weekly. After form submission the user receives a confirmation email with a unique link; only after clicking the link does the subscription become active, the address is added to the contact list, and the user accesses the document download.
Purpose
Data collected is processed to: (1) deliver the requested document via download page and email; (2) record consent confirmation (double opt-in); (3) send subsequent issues of the TDS Weekly newsletter. It is not used for profiling, advertising targeting, or transfer to third parties. Withdrawal of consent does not affect the lawfulness of processing before withdrawal (Art. 7.3 GDPR).
Data processor: Brevo
The technical management (confirmation email delivery, document delivery, subscription and unsubscribe handling) is entrusted to Sendinblue SAS (Brevo brand), 106 Boulevard Haussmann, 75008 Paris, France, with servers located within the European Union (France, Germany, Belgium). Brevo acts as Data Processor pursuant to Art. 28 GDPR, on the basis of the Data Processing Agreement available at help.brevo.com. No data is transferred outside the EU.
Retention and withdrawal
The email address is retained until consent is withdrawn; the consent log (subscription date, DOI confirmation, possible withdrawal) is retained for 24 months after withdrawal (Art. 7.1 GDPR). Every email contains an "Unsubscribe" link for immediate and free withdrawal; alternatively, requests can be sent to privacy@tds-automation.com.
14. Changes
This policy may be updated. The date of the last update is shown at the bottom of the page.
Last updated: 13 October 2026 — sections 5, 6, 7, 7.1 and 9. New ARIA voice (Google Gemini instead of ElevenLabs, Deepgram as backup voice); transcription on servers in the European Union with no retention by the provider; the transcript is no longer retained by us and ARIA does not search previous conversations. Since 12 October 2026 ARIA is only a voice (Beyond Presence no longer receives data) and session recording on LiveKit is switched off. Corrected: for Deepgram we had written “SCC”, but the data processing agreement is not in place yet (we have requested it, awaiting reply); for LiveKit we had written “US servers”, but the connection uses the closest server, with no EU guarantee, and LiveKit also receives the IP address and keeps technical analytics data; for Google we had written “EU/US servers” and did not say that it keeps the text for up to 55 days for abuse monitoring; for Google Workspace we had written “EU/US servers”: we now state the contract with Google Ireland Limited and that the servers may also be outside the EU; the “no training” statement holds for Deepgram only from 8 October 2026, and for ElevenLabs it is being checked. Added what was missing about quotes and requests for prices made to ARIA: internal archive, OpenAI for the search vector, Google Workspace for the emails, bookings on Calendly or Google Calendar, legal basis and retention. The ARIA page used to download its technical library from the jsDelivr service, which saw the IP address, and we did not say so: from this update we serve it from our own website. Also added the legal basis for technical data and the IP address (legitimate interest), the initial and domain of the email address in the logs, and the gap on their retention period. A single address for your rights: privacy@tds-automation.com. The system was also set to alert Paolo Consorti on Telegram, with name, email address and request: according to our checks no such alert was ever sent, and from this update the alert arrives by email only. — 31 July 2026: section 7.1 corrected: the conversation transcript may be retained (previously we only stated that audio is not), OpenAI added among the sub-processors for vectorising the retained text, the IP address added among the recorded data, and the automatic session start for returning visitors who already consented. — 30 July 2026: added section 7.1 on the ARIA voice assistant and its sub-processors; corrected the pseudonymisation statement, which cannot hold for voice.
